For real estate or commercial property shoots please see terms of service. All other shoots please note: If, for any reason, you are unable to keep your scheduled appointment please give 24 hours notice so we can reschedule you at a more appropriate time and open your time slot to others. Cancellations with less than 24 hours notice may incur a $50 cancellation fee. Once shoot is complete, there are no refunds.
Terms of Service:
1) If the photographer cannot adequately shoot the property once they arrive due to reasons beyond our control (such as, but not limited to a) unable to gain access to the property b) excessive clutter and mess c) unrestrained animals, you will be charged the full fee of the shoot.
2) It is the Realtor or property’s agent and/or property owner's responsibility to have the property in photo ready condition prior to the photographer arriving. The photographer may make minor adjustments to improve the shot, but they cannot move furniture or make significant changes, clean the property, etc. Be sure to read the property prep guide several days prior to your shoot to make sure you are ready to capture the best photos possible.
3) If, for any reason, you are unable to keep your scheduled appointment please give 24 hours notice so we can reschedule you at a more appropriate time and open your time slot to others. Cancellations with less than 24 hours notice may incur a $50 cancellation fee. Any shoot scheduled for twilight will incur a cancellation fee of $150 if cancelled less than 3 business days of the scheduled shoot. We reserve the right to offer a credit instead of a refund less cancellation fee.
4) Please make any special requests known to the photographer before the shoot begins, including specific shots, angles and the like. Otherwise the photographer will shoot the property based on experience, the property's condition, lighting and other factors to get the best possible shots. That sometimes means making compromises when it is necessary to shoot around things or compensate for the angle of the sun.
5) Turnaround time is 24 -48 hours. Although you may get your photos back in less time we cannot guarantee it. If you have a situation that requires a quicker turn around time please inquire about options for express service at an additional fee.
6) Payment is due at the time of the shoot by credit card on site or for your convenience you may pay securely online with a credit card ahead of time.
7) All Photos and rights relating to them, including copyright and ownership rights in the media in which the Photos are stored, remain the sole and exclusive property of the Photographer. This license provides the Client with the limited right to reproduce, publicly display, and distribute the Photos only for promotional or advertising purposes directly related to the sale of the Property. Photos used for any purpose not directly related to the sale of the Property must be with the express permission of Photographer and the payment of additional fees, unless otherwise agreed to in writing. Photos may be uploaded to any MLS listing service solely for promotion of the Property during the pendency of this Agreement. However, regardless of any terms and conditions of the MLS, at no time does this Agreement provide Client with the right to transfer copyright, or any other exclusive rights as provided by the Copyright Act 17 U.S.C § 106. Photos may contain copyright management information (CMI) at the discretion of the Photographer in the form of either 1) a copyright notice © and/or 2) other copyright and ownership information embedded in the metadata or elsewhere, unless otherwise agreed to by the Parties. Removing and/or altering such information is prohibited and constitutes violation of the Digital Millennium Copyright Act (DMCA) and Client will be responsible to the Photographer for any penalties and awards available under the statute. Client is responsible for ensuring that the Photos are removed from MLS databases at the expiration of this Agreement.
